The Environmental License To Drill In Yasuní In The Making

While Brazilian oil expands in the world, in Ecuador it does not manage to consolidate its project to extract crude oil in Yasuni National Park, one of the most biodiverse zones on the planet.

The Commission of Civic Control of Corruption (CCCC) analyzed the case of Petrobras in Yasuní. December 1, the Plenary session of this organization approved a report on the presumed irregularities to the granted environmental license to Petrobras in Block 31.

The route that Petrobras opened from the Napo River towards Yasuní is 17 kilometers.

Between the conclusions, the CCCC established indications of guilty administrative responsibility on Patricio Viteri, ex- director of Prevention and Environmental Control of the Ministry of the Environment; Fabian Valdivieso, ex- minister of the Environment, and Vicente Juepa, ex- Undersecretary of Environmental Protection of the Ministry of Energy and Mines.

The justification is that for the admission of the license, requirements established in the environmental legislation were not fulfilled.

Such indications of responsibility “administrative guilt” were considered for Vinicio Valarezo, ex- undersecretary of Environmental Quality of the Ministry of the Environment, for the use of funds for aims different from the established ones in the license.

Valdivieso said to not know of the Anticorruption report, but it confirmed that these days the period to present/display the proof of discharging the examination that the Contraloría made on the given authorization to Petrobras.

As far as handling the depth of the Plan of Program of Following and Monitoring the Environment, the Ministry must allocate these resources of exclusive form for the aim that they were given, according to the CCCC.

In addition, Anticorruption requested to the Ministry of the Environment to revoke the granted license to Petrobras for the breaches of authorization, known as “greater unconformities”. Like the entrance of ships with heavy equipment by the Tiputini River and the lack of authorization to enter the protected area.

According to Robert Urquizo, undersecretary of Environmental Quality of the Ministry of the Environment, the State analyzes the subject with technicians and lawyers, but a decision has not yet been adopted on Yasuní.

On the other hand, Petrobras indicated that it is not going to give comments on the report of the CCCC.

Urquizo recognized that Petrobras made a proposal to explore the block changing the project according to the recommendations of the Ministry of the Environment. They made some adjustments to the plan like not constructing the road inside the Park and constructing the Center of Facilities of Production (CPF) outside the protected area.

La licencia ambiental del Yasuní en ciernes

Mientras la petrolera brasileña se expande en el mundo, en el país no logra consolidar su proyecto para extraer crudo en el Parque Nacional Yasuní, una de las zonas más biodiversas del planeta.

La Comisión de Control Cívico de la Corrupción (CCCC) analizó  el caso de Petrobras en el Yasuní.  El Pleno de esta entidad aprobó, el 1 de diciembre, un informe  sobre las presuntas irregularidades vinculadas a la licencia ambiental otorgada a Petrobras en el Bloque 31.

Entre las conclusiones, la CCCC establece indicios de responsabilidad administrativa culposa a Patricio Viteri, ex director de Prevención y Control Ambiental del Ministerio del Ambiente; Fabián Valdivieso, ex ministro del
Ambiente, y Vicente Juepa, ex Subsecretario de Protección Ambiental del Ministerio de Energía y Minas.

La justificación es que para la emisión de la licencia no se cumplieron los requisitos establecidos en la legislación ambiental.

Los mismos indicios de responsabilidad ‘administrativa culposa’ se dictaminaron para  Vinicio Valarezo, ex subsecretario de Calidad Ambiental del Ministerio del Ambiente,  por el uso de fondos para fines distintos de los establecidos en la licencia.

Valdivieso dijo desconocer  el informe de Anticorrupción, pero confirmó que estos días termina el plazo para presentar las pruebas de descargo del examen que realizó la Contraloría sobre la autorización  dada   a Petrobras.

En cuanto al manejo de los fondos del Plan de Programa de Seguimiento y Monitoreo Socioambiental, el Ministerio debe destinar estos recursos de forma exclusiva para el fin que fueron entregados, según la CCCC.

Además, Anticorrupción pidió al Ministerio del Ambiente que revoque la licencia otorgada a Petrobras por los incumplimientos de la autorización, conocidos como ‘no conformidades mayores’. Como el ingreso de barcazas con equipo pesado por el río Tiputini y  la falta de autorización para el ingreso al área protegida.

Según  Roberto Urquizo, subsecretario de Calidad Ambiental del Ministerio del Ambiente, en esa cartera de Estado analizan   el tema con técnicos y abogados, pero aún no se adopta una decisión sobre el Yasuní.

Por su parte, Petrobras indicó que no va a dar declaraciones sobre el informe de  la CCCC. 

Urquizo reconoció que Petrobras hizo  una propuesta para explotar el bloque cambiando el proyecto de acuerdo a las recomendaciones del Ministerio del Ambiente. En éste se hacían algunos ajustes al plan como el  no construir la vía dentro d el Parque y levantar el Centro de Facilidades de Producción (CPF) fuera del área protegida.
